Access to and use of the services of In Case You Travel, LLC ("In Case You Travel," "ICYT," "we," "us," or "our") is subject to acceptance of these terms and conditions ("Terms and Conditions" or "Terms"). By accessing, using, or obtaining any content, products, or services through In Case You Travel — including by paying a deposit, submitting a booking form, or authorizing payment — the purchaser and/or traveler ("Client," "passenger," "you," or "your") agrees to be bound by these Terms. These Terms govern the relationship between In Case You Travel and you. These Terms restrict your rights and remedies and provide protections to In Case You Travel, including warranty disclaimers, liability exclusions, a binding arbitration provision, and a class action waiver. IF THERE IS ANY PART OF THESE TERMS YOU DO NOT AGREE WITH, PLEASE DO NOT USE IN CASE YOU TRAVEL'S SERVICES. No alteration to these Terms may be made by any In Case You Travel representative or agent unless in writing signed by an authorized officer of In Case You Travel.
1. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS
It is the responsibility of each Client to obtain and carry a valid passport, visa(s), REAL ID-compliant identification where required, and all other documents required by applicable government regulations. The U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight; see. The name, date of birth, and gender appearing on the identification must exactly match the same data listed on airline ticket(s) and booking records. In Case You Travel is not responsible for denied boarding, denied entry, or other losses resulting from a name mismatch or from a Client's failure to obtain or carry required documentation.
In Case You Travel strongly recommends you take into account that certain countries will not admit a passenger whose passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. It is the Client's responsibility to advise In Case You Travel when traveling on a passport from a country other than the United States of America; failure to do so releases In Case You Travel from any liability arising from documentation requirements applicable to that nationality.
Children and infants also require travel documents. Minors traveling with one parent and/or without both parents may be stopped and not admitted unless authenticated and verified consent forms are provided to the authorities; see for additional information. Parental or legal guardian consent must be provided to the supervising adult/Group Leader where applicable.
You acknowledge that any failure to strictly comply with these requirements may result in denied boarding or undue delay causing you to miss flight(s) and subsequent scheduled travel bookings, with no refund owed by In Case You Travel. Check each supplier's website to ensure that you and all members of your travel party obtain and carry the required travel documentation.
2. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
Each foreign country holds different views of past criminal offenses. If you have a current or past offense and are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements (see). In the interest of respecting our Clients' privacy, we do not inquire about criminal records. In Case You Travel neither controls nor warrants the issuance of visas or approval of visa waivers, and is not responsible for any losses, including lost payments, arising from a denial of entry, exit, or visa issuance.
3. HAZARDOUS MATERIALS
USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger's luggage or on the passenger's person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger's luggage and certain smoking materials carried on the passenger's person. 4. INSECTICIDE NOTICE
Some countries require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. Passengers should check the DOT's current list at, as it is updated from time to time.
5. HEALTH, IMMUNIZATIONS, AND FITNESS TO TRAVEL
Each Client is responsible for confirming and obtaining the proper immunizations, health documentation, and testing required for each destination before travel. In Case You Travel does not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon arrival. See your health practitioner for advice before booking. Check and for destination-specific information.
By booking, you represent that you and all members of your booking are physically and mentally fit to travel and that traveling will not endanger yourself or others. It is the Client's responsibility to disclose, at or before booking, any mobility limitation, medical condition, or special need requiring accommodation. In Case You Travel will make reasonable efforts to communicate requests to suppliers but cannot guarantee accommodation, and is not liable for a supplier's inability or failure to accommodate.
COMMUNICABLE ILLNESS. Client acknowledges that travel involves an inherent risk of exposure to communicable diseases, including but not limited to COVID-19 and its variants. Client voluntarily assumes all risk related to such exposure and agrees that In Case You Travel is not liable for any illness, quarantine costs, testing requirements, entry restrictions, or trip disruption related to communicable disease. Health-related entry requirements are the Client's sole responsibility and may change without notice.
6. USE OF IN CASE YOU TRAVEL SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with In Case You Travel in accordance with all Terms herein. You agree to be financially responsible for all of your travel bookings and warrant that all information supplied by you or members of your household is true and accurate. Any speculative, false, or fraudulent reservation is prohibited.
BOOKING FOR OTHERS. If you make a booking on behalf of another person, you represent and warrant that you have that person's authorization to accept these Terms on their behalf, that you have accurately conveyed their information, and that you will provide them a copy of these Terms and all travel documentation. You agree to indemnify In Case You Travel for any claim by a person on whose behalf you booked arising from your failure to do so.
Separate supplier terms and conditions apply to your reservation and purchase of travel-related goods and services. You agree to abide by the terms and conditions imposed by In Case You Travel and by any supplier, including, without limitation, payment of all amounts when due and compliance with each supplier's rules and restrictions regarding availability and use of fares, products, or services. Violation of a supplier's conditions may result in cancellation of your reservation, denial of access to flights, hotels, cruises, or vehicles, forfeiture of monies paid, and In Case You Travel charging your payment account for any costs it incurs as a result of such violation. You are responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings.
When you receive any travel documents, it is your sole responsibility to review and verify all information immediately and to contact In Case You Travel at once if changes or corrections are required. Corrections requested after issuance may be subject to supplier fees or may not be possible. If you have authorized In Case You Travel to check you in for any component of your trip, you take full responsibility for agreeing to and complying with the supplier's check-in terms.
7. AGENCY STATUS; SELLER OF TRAVEL
In Case You Travel, LLC is a travel management company based in Virginia Beach, Virginia. [VERIFY AND UPDATE: If ICYT still books through a host agency, state it here, e.g., "In Case You Travel is an Independent Contractor of KHM Travel Group, California Seller of Travel Registration No. ____." If ICYT now operates under its own IATA accreditation and its own Seller of Travel registrations, state the applicable registration numbers for California, Florida, Washington, and Hawaii if soliciting clients in those states.] Registration as a seller of travel does not constitute approval by the State of California.
8. DEPOSITS, PAYMENTS, PAYMENT PLANS, AND CANCELLATIONS
Unless otherwise defined during the reservation process, final payment is due prior to departure according to each supplier's terms and conditions. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and all deposits and payments made shall be forfeited. In some cases there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited.
NON-REFUNDABLE FEES AND DEPOSITS. All planning fees, consultation fees, service fees, and administrative fees charged by In Case You Travel are earned when paid and are non-refundable, non-transferable, and separate from supplier payments. Unless expressly stated otherwise in writing, all deposits are non-refundable.
PAYMENT PLANS. Where a payment plan is offered, all installments must be received on or before their due dates. A missed installment constitutes a default, and In Case You Travel and its suppliers may cancel the booking and apply the cancellation penalties in effect at that time. Late payments may be subject to a late fee where stated in your invoice or payment plan agreement. Client is responsible for keeping payment card information current.
CANCELLATIONS. All cancellation requests must be sent to In Case You Travel in writing. Cancellation penalties of In Case You Travel and of third-party suppliers will apply, as detailed in your travel documentation and each supplier's terms. We advise you of cancellation penalties at the time of booking and upon confirmation. All cancellation fees will be charged to the payment method you authorized or deducted from any supplier refund. No refund will be issued for a Client who fails to appear, departs early, or is removed from a trip under these Terms.
9. CHARGEBACKS AND PAYMENT DISPUTES
By providing a payment method to In Case You Travel, you authorize the charges for your booking, including supplier payments processed on your behalf, and you agree not to initiate a chargeback or payment dispute for valid charges, for supplier cancellation penalties disclosed to you, for services actually rendered, or as a means of avoiding these Terms. You agree to contact In Case You Travel in writing and allow thirty (30) days to resolve any billing concern before initiating a dispute. You agree to reimburse In Case You Travel for any chargeback of a valid charge, including associated bank fees, administrative costs, and reasonable attorneys' fees incurred in responding to or contesting the dispute. In Case You Travel reserves the right to pursue collection of amounts owed and to refuse future service to Clients who initiate improper chargebacks.
10. LATE BOOKINGS
Prospective Clients are advised to reserve early to avoid disappointment and additional late booking fees. Bookings requested inside supplier deadlines may incur rush fees and may limit available options.

11. AIR, CHECK-IN, AND SCHEDULE RECONFIRMATION
Airline reservations are included in your travel plans unless excluded at the Client's request. Your confirmation and travel documentation will state whether air is included in your booking. IF CLIENT ELECTS TO ARRANGE THEIR OWN AIR TRAVEL, CLIENT ASSUMES FULL RESPONSIBILITY FOR THOSE ARRANGEMENTS, including selecting flights that align with the trip itinerary, transportation to and from the destination where the travel booking originates and returns, and all consequences of schedule changes, delays, cancellations, or misconnections affecting self-arranged air. In Case You Travel is not responsible for monitoring self-arranged air and owes no refund for trip components missed due to self-arranged air disruptions. Whether air is booked by In Case You Travel or by the Client, In Case You Travel shall not assume any responsibility for any air and/or ground schedule changes, which are within the sole control of the airline or supplier. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure for domestic flights and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from issue date unless carrier fare rules provide otherwise.
12. RIGHT TO CORRECT ERRORS; PRICES SUBJECT TO CHANGE
We reserve the right to correct errors. All offers are subject to availability and may change without notice. In the event of a pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. Until final payment is received, prices are subject to increase due to supplier price increases, fuel surcharges, taxes, fees, and currency fluctuation, and Client authorizes such increases to be charged to the payment method on file after notice. By paying a deposit before final payment, Client accepts this right to increase and waives any right to cancel solely on that basis except where prohibited by law.
13. TOURS AND GROUPS: NO REFUND FOR UNUSED ARRANGEMENTS; MINIMUM PASSENGER REQUIREMENTS
Because tour, cruise, and package prices are based on suppliers' contract rates, there will not be any refund for any unused portion of a tour. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour may be canceled. Any cancellation of a tour or package for failure to meet minimum traveler requirements will be governed by the tour operator's cancellation policy.
14. GROUP TRAVEL TERMS
For group trips organized or hosted by In Case You Travel: (a) itineraries, hotels, and inclusions are subject to change with reasonable substitutions of comparable quality; (b) roommate-matching, where offered, is a courtesy only — In Case You Travel does not guarantee compatibility and is not liable for disputes between roommates, and if a matched roommate cancels, the remaining traveler is responsible for the applicable single supplement; (c) pricing is based on double occupancy unless stated otherwise; (d) name changes and substitutions are subject to supplier rules and fees and may not be permitted; (e) travelers who separate from the group do so at their own risk and expense, and no refund is owed for missed group activities; and (f) In Case You Travel reserves the right to decline or remove any participant whose conduct is incompatible with the group experience, with no refund owed.
15. ALTERATIONS TO CONFIRMED BOOKINGS
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and changes may incur supplier fees plus an In Case You Travel change fee where disclosed. All desired changes must be made in writing to In Case You Travel. Alterations in itinerary may also be necessitated by suppliers for any number of reasons, including severe weather, at the sole discretion of the supplier and subject to supplier terms and conditions.
16. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
In Case You Travel acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, tour operators, and other independent contractors providing accommodations, transportation, and/or other services ("supplier(s)"), and is not the source or provider of the travel services. Each supplier is an independent entity with its own management and is not subject to the control of In Case You Travel. The suppliers whose names appear in your travel documentation are those actually responsible for providing the travel services purchased. Client consents to the use of those suppliers and agrees that each supplier's terms and conditions, contained in printed form and set forth on their respective websites, govern the transaction. All bookings are accepted by In Case You Travel as agent for the travel suppliers on your itinerary.
BECAUSE IN CASE YOU TRAVEL ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT IN CASE YOU TRAVEL IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE WHICH MAY ARISE OUT OF THESE SERVICES. IN CASE YOU TRAVEL HEREBY DISCLAIMS ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKED THROUGH IN CASE YOU TRAVEL'S OFFICE OR THROUGH ITS WEBSITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS, OR OTHERWISE OF SUCH SUPPLIER OR ITS EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, BANKRUPTCY OR INSOLVENCY OF ANY SUPPLIER, AND OTHER MATTERS OUTSIDE OF IN CASE YOU TRAVEL'S CONTROL, AND YOU HEREBY RELEASE AND EXONERATE IN CASE YOU TRAVEL FROM ANY LIABILITY WITH RESPECT TO THE SAME.
Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall, are not guaranteed and are outside of In Case You Travel's control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or natural disaster by suppliers and your travel insurance company, which is beyond the control of In Case You Travel. In Case You Travel reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time.
LIMITATION OF DAMAGES. IN CASE YOU TRAVEL RECEIVES ONLY COMMISSIONS AND FEES FOR TRAVEL TRANSACTIONS. CLIENT AGREES AND UNDERSTANDS THAT IN CASE YOU TRAVEL'S MAXIMUM AGGREGATE LIABILITY TO CLIENT FOR ANY CLAIM WHATSOEVER, REGARDLESS OF THE FORM OF ACTION, SHALL BE LIMITED TO THE COMMISSIONS AND FEES PAID BY CLIENT AND ACTUALLY RECEIVED AND RETAINED BY IN CASE YOU TRAVEL FOR THE BOOKING GIVING RISE TO THE CLAIM.
17. RISKS AND SAFETY; ASSUMPTION OF RISK
Travel to certain destinations may involve greater risk than others. In Case You Travel urges Clients to remain informed daily as to current events and to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel. Information can be found at, and. The Smart Traveler Enrollment Program (STEP) is a free U.S. Government service; registration is recommended at https://step.state.gov/step/.
BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, IN CASE YOU TRAVEL DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT VOLUNTARILY ASSUMES ALL RISKS INHERENT IN TRAVEL, AND CLIENT'S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH RISKS AT CLIENT'S OWN RISK.
18. FORCE MAJEURE
"Force Majeure" means any circumstance beyond the reasonable control of In Case You Travel, including, without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, epidemic, pandemic, quarantine, government intervention or travel restriction, weather conditions, defects in machinery and vehicles, delay, wildlife, cyber incidents affecting suppliers, or other untoward occurrences.
In Case You Travel shall not be deemed in breach of these Terms or otherwise liable to you by reason of delay in performance or non-performance of any of its obligations to the extent that such delay or non-performance is due to Force Majeure. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS. IN CASE YOU TRAVEL CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM.
If In Case You Travel and/or any of its travel suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement. Payment of any refund by In Case You Travel to you as a result of non-performance shall remain in its sole and absolute discretion, although In Case You Travel shall use reasonable efforts to secure reimbursement for you where possible. In Case You Travel shall be entitled to deduct from any refund the reasonable actual and potential costs of the Force Majeure and applicable cancellation fees. Regarding civil unrest or other emergent safety concerns, once In Case You Travel has investigated the prevailing situation as it deems fit, it shall remain in In Case You Travel's sole and absolute discretion whether to proceed with any escorted trip or private departure. You may in such circumstances cancel the trip subject to In Case You Travel's and each supplier's terms and conditions.
19. CLIENT CONDUCT AND INDEMNIFICATION
Each participant in any trip arranged or escorted by In Case You Travel is expected to act responsibly and adhere to all behavior guidelines established by In Case You Travel and our suppliers. In Case You Travel and all local suppliers reserve the right to remove you from any facility, property, tour location, or means of transportation if your health or conduct appears to endanger yourself or others, disrupts the general well-being of other clients, or interferes with the operation or security of the places visited. In any such case there will be no refund, and you are responsible for all costs of your removal, accommodation, and return travel.
When you book with In Case You Travel, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner, manager, or other supplier. You agree to indemnify, defend, and hold harmless In Case You Travel, its owners, officers, employees, and independent contractors from and against any claim, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to your acts or omissions, your breach of these Terms, your violation of any law or supplier policy, or claims brought by persons on whose behalf you booked. We are not responsible for any costs incurred concerning a guest removed from a trip or any portion of a trip. Baggage and personal effects are at all times the sole responsibility of the participant.
20. CURRENCY FLUCTUATIONS
Currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred. In Case You Travel is not responsible for surcharges or foreign transaction fees imposed by Client's credit card issuer or bank.
21. TRAVEL INSURANCE; INSURANCE WAIVER
IN CASE YOU TRAVEL OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT'S ITINERARY. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES, INCLUDING SUPPLIER DEFAULT/BANKRUPTCY, DELAY, INTERRUPTION, MISSED CONNECTIONS, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION AND REPATRIATION, BAGGAGE AND PERSONAL EFFECTS, ILLNESS, AND MORE.
Without appropriate travel insurance, Client understands and agrees that if Client cancels or interrupts travel for any reason, portions of the trip may not be refunded and In Case You Travel's and suppliers' cancellation penalties will apply, resulting in the loss of monies up to the full cost of the booking and related costs. IF CLIENT DECLINES TRAVEL INSURANCE OFFERED, CLIENT ASSUMES ALL RISK OF FINANCIAL LOSS AND AGREES TO HOLD IN CASE YOU TRAVEL HARMLESS FOR ANY LOSS THAT WOULD HAVE BEEN COVERED BY SUCH INSURANCE; In Case You Travel may require a written or electronic insurance waiver documenting the declination. The purchase of travel insurance is not required in order to purchase any other product or service offered by In Case You Travel. In Case You Travel is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, or conditions of any insurance offered, nor to evaluate the adequacy of the prospective insured's existing coverage. An additional charge applies for any travel insurance selected.
22. PHOTO, VIDEO, AND MARKETING RELEASE
On group trips and hosted events, In Case You Travel and its representatives may take photographs and video that include Client's image or likeness. Unless Client opts out in writing before departure, Client grants In Case You Travel a perpetual, royalty-free license to use such photographs and video for marketing and promotional purposes, including on its website and social media, without compensation. Client may revoke this consent prospectively at any time by written notice.
23. COMMUNICATIONS CONSENT
By providing your contact information, you consent to receive transactional and service communications from In Case You Travel by email, telephone, and SMS/text message regarding your bookings. Where you have separately opted in, you also consent to receive marketing communications, which you may opt out of at any time by following the unsubscribe instructions or replying STOP to text messages. Message and data rates may apply. Consent to marketing messages is not a condition of purchase. Our collection and use of personal information is described in our Privacy Policy, available on our website.
24. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Before initiating any formal proceeding, Client agrees to first contact In Case You Travel in writing and attempt in good faith to resolve the dispute informally for thirty (30) days.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY BOOKING THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED IN VIRGINIA BEACH, VIRGINIA, BEFORE A SINGLE ARBITRATOR, IN ACCORDANCE WITH THE APPLICABLE RULES OF A RECOGNIZED ARBITRATION PROVIDER AGREED BY THE PARTIES. CLIENT AND IN CASE YOU TRAVEL EACH WAIVE THE RIGHT TO A TRIAL BY JURY. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Either party may bring an individual claim in small claims court in lieu of arbitration where the claim qualifies.
TIME LIMIT ON CLAIMS. To the fullest extent permitted by law, any claim against In Case You Travel must be commenced within one (1) year after the date of return of the trip giving rise to the claim (or the scheduled return date if the trip did not occur), or the claim is permanently barred.
ATTORNEYS' FEES. In any proceeding to enforce these Terms or to collect amounts owed to In Case You Travel, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs to the extent permitted by law.
25. RESERVATION OF RIGHTS; CHANGES TO THESE TERMS
We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions will be posted on our website and are effective immediately upon posting. Continued use of our services after posting constitutes acceptance of the updated Terms. The version of these Terms in effect at the time of your booking governs that booking.
26. GENERAL
The laws of the Commonwealth of Virginia govern these Terms and Conditions, without regard to conflict of laws principles. Subject to the arbitration provision above, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Virginia Beach, Virginia, in all disputes arising out of or relating to travel bookings with In Case You Travel.
If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Terms shall continue in full force and effect. In Case You Travel's failure to enforce any provision shall not constitute a waiver of that or any other provision.
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and In Case You Travel with respect to travel bookings made with In Case You Travel by any means, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial, arbitral, or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
